The Athlone Magistrate’s Court has sparked widespread public and civic outrage after granting R5,000 bail each to three men arrested in Nyanga in possession of a high-powered arsenal, including AK-47 rifles, a handgun, and hundreds of rounds of live ammunition.

The state had strongly opposed the bail application given the severity of the charges and the ongoing crisis of violent crime across the Cape Flats, but the magistrate ultimately ruled in favour of releasing the accused pending further investigation.
The case has been postponed to January next year.
The tactical intercept and seizure
The arrests followed a targeted operational response by City of Cape Town Law Enforcement Advancement Plan (LEAP) officers operating in Crossroads, Nyanga, after receiving an urgent tip-off from members of the public. Officers intercepted a suspicious Ford Ranger and conducted a thorough search of the vehicle.
The inspection led to the discovery of an extensive weapons cache, which included four high-powered rifles, a 9mm pistol, over 350 rounds of live ammunition, multiple fraudulent vehicle registration plates, and suspicious electrical gear suspected of being used in criminal syndicate operations.

The magistrate’s ruling has ignited fierce public backlash across Cape Town, coming at a time when communities are reeling from a devastating wave of gun violence. Recent mass shooting incidents across Gauteng and the Western Cape claimed more than 30 lives in a single weekend, including a mass shooting that left 27 dead in late September.
Municipal leadership and local anti-crime activists condemned the court’s decision, warning that releasing individuals found with war-grade weaponry severely undermines frontline policing efforts.
Mayoral Committee Member for Safety and Security, JP Smith, voiced deep frustration over judicial leniency, emphasising that returning dangerous suspects onto township streets directly jeopardises public safety and hampers ongoing efforts to disarm organised crime syndicates.
