As graphic reports of violent assaults and fatal attacks dominate daily headlines, citizens are increasingly expressing profound anger toward a justice system perceived as lenient and ineffective.
This escalating climate of fear and grief has reignited an intense national debate, fueling rapidly growing public petitions that demand the reinstatement of capital punishment as a necessary deterrent.
A national crisis driven by alarming figures
Recent official quarterly crime figures released by the South African Police Service (SAPS) reveal that 569 women were murdered between April and June 2026 alone, averaging roughly six women killed every single day.
The horrifying discovery of multiple women’s bodies across Kempton Park and broader Ekurhuleni over recent weeks has further intensified widespread panic, forcing high-level interventions from law enforcement and the Presidency.

In response to what many view as a collapsing state of public safety, prominent figures including comedian David Kau have voiced fierce support for bringing back the death penalty online.
Digital petitions demanding capital punishment for violent offenders, rapists, and murderers have rapidly surpassed 54,000 signatures, accompanied by highway billboards proclaiming that crime in South Africa has spiralled entirely out of control.
The legal barrier and constitutional realities
While public outrage continues to grow, legal scholars and constitutional experts point out that reinstating capital punishment is far from a straightforward policy shift. The death penalty was declared unconstitutional in the landmark 1995 S v Makwanyane ruling, which established that the state cannot violate the fundamental right to life and human dignity enshrined in the Bill of Rights.
Overturning this constitutional ban would require a massive two-thirds parliamentary majority to amend the Constitution, a political hurdle few party coalitions are prepared to navigate.
