
Former president Jacob Zuma and the MK party have filed an urgent High Court application against President Cyril Ramaphosa after losing a Constitutional Court bid on 31 July 2025.
They want the court to declare invalid Ramaphosa’s decision to place Police Minister Senzo Mchunu on special leave, appoint Wits law professor Feroz Cachalia as acting police minister, and establish a commission of inquiry led by Acting Deputy Chief Justice Mbuyiseli Madlanga.

Zuma argues these moves are unconstitutional, irrational, and made in bad faith, claiming there is no legal basis for suspending a minister and that the actions benefit Mchunu financially while shielding him from accountability.
The former president says the matter is urgent because the commission has already begun operating at taxpayer expense and is dealing with explosive claims of criminal infiltration in the justice system by KZN police chief Nhlanhla Mkhwanazi.
He accuses Ramaphosa of avoiding judicial scrutiny on technical grounds in the ConCourt case and insists the High Court now has jurisdiction under the Constitution.
The hearing is set for 26 August 2025.
