Former Crime Intelligence deputy head Major-General Feroz Khan is facing criminal charges after failing to appear before the Madlanga Commission of Inquiry earlier today, 28 September 2026.

Madlanga rejects postponement request
Khan’s legal team had sought a postponement of his appearance, reportedly requesting about a month’s delay. The request was rejected by commission chairperson Justice Mbuyiseli Madlanga.
According to The Citizen, Madlanga said Khan’s failure to attend amounted to a disregard of the subpoena issued by the commission. The commission subsequently directed that criminal charges be pursued over his non-attendance.
Evidence leader Advocate Adila Hassim also asked that Khan’s failure to appear be referred to the National Prosecuting Authority for consideration, arguing that his absence constituted a breach of the relevant provisions governing commissions of inquiry.

Feroz Khan’s testimony has been repeatedly delayed
Khan’s appearance before the commission has been postponed on several occasions. He was originally expected to testify in July, but his appearance was delayed after he was shot in Johannesburg on 28 June.
Reports say he subsequently failed to appear before the commission on 1 September. At the time, his legal team cited medical reasons for his absence. The commission later set today, 28 September, as the date for his testimony, subject to conditions concerning an independent medical assessment, which he also failed to attend.
Reports say that his legal representatives have maintained that his health has affected his ability to participate in proceedings.

Commission is expected to hear Feroz Khan’s evidence
Despite this morning’s developments, Khan is still expected to give evidence before the commission. SABC News reported that his appearance is scheduled for 6 October, with part of his testimony potentially being heard on camera.
The commission has previously heard allegations involving Khan, including claims relating to his interactions with individuals connected to investigations into alleged organised crime and corruption. The commission’s official profile stresses that allegations presented during the inquiry are not findings of guilt.
The latest charges relating to his failure to appear before the commission are separate from criminal allegations Khan faces for the alleged corruption, defeating the ends of justice and contraventions of the Precious Metals Act.
The latest development means Khan now faces additional legal consequences over his failure to comply with the Madlanga Commission’s subpoena, while his long-awaited testimony remains pending.
