The couple appeared before the High Court on Thursday, where their bid to overturn the magistrate’s decision was unsuccessful.

Court cites risk of witness interference

The court upheld the earlier denial of bail, with concerns reportedly centred on the risk of witness interference and the seriousness of the charges against the couple.

Gagash and Charlotte face 123 charges, including fraud, theft and money laundering.

The allegations relate to approximately R11 million that prosecutors claim was stolen and laundered from 15 deceased estates that Charlotte managed.

Couple accused of using funds for luxury purchases

According to the prosecution, the allegedly misappropriated funds were used for various purposes, including the purchase of a luxury Mercedes-Benz, property development projects and stokvels.

The allegations form part of the state’s case against the couple, who remain in custody following Thursday’s ruling. Gagash is a Tshwane Metro Police officer, while Charlotte was responsible for managing the deceased estates linked to the allegations.

The bail proceedings have focused on whether the couple should be released while the criminal case against them continues.

Gagash and Charlotte remain in custody

Following the dismissal of their bail appeal, Gagash and Charlotte will remain behind bars until their next court appearance on 6 November 2026.

Meanwhile, two of their co-accused have been granted bail of R60,000 each.
