Tshwane Metro Police Department (TMPD) officer Peter ‘Gagash’ Nonyane and his wife, attorney Charlotte Tibana, are expected to learn on Friday, 4 September 2026, whether they will be granted bail.

The couple appeared in the Polokwane Magistrate’s Court on Thursday, where the State and defence concluded their arguments in the bail application. Magistrate Godfrey Netshiozwi reserved judgment for midday on Friday, Jacaranda FM reports.
Couple facing 43 charges
Gagash and Charlotte are facing 43 charges, including fraud, theft and money laundering, relating to allegations involving funds from deceased estates.
According to the State, the couple allegedly misappropriated millions of rand from estate accounts. SABC News reported that the alleged amount involved is around R6 million from the estates of six families. The allegations have not been tested at trial, and both accused remain presumed innocent.
The case has attracted considerable attention because of Gagash’s public profile as a TMPD officer and social media personality.
Defence argues they should be released
During Thursday’s proceedings, defence advocate Hlawu Maluleke argued that bail should not be used as a form of punishment before an accused person has been convicted.
According to Jacaranda FM, the defence maintained that both Gagash and Charlotte are first-time offenders and argued that they have fixed addresses and are not flight risks. They also indicated that the pair would be willing to comply with strict bail conditions if released.
SABC News reported that the defence proposed that the accused provide their daily locations and report to nearby police stations daily should bail be granted.
Charlotte’s defence has also highlighted her responsibilities as a parent and the need for her to continue managing her law firm.
Gagash, meanwhile, told the court in a supplementary affidavit that he earns additional income through work as an events coordinator and MC at a Pretoria nightclub.

State opposes bail
The State has strongly opposed the couple’s release.
Investigating officer Constable Khutsiso Thobejane previously told the court that he was concerned the accused could interfere with witnesses or the investigation if released.
SABC News reported that the State has also questioned information provided by Gagash in his initial bail affidavits. Prosecutor Advocate Martin Molokwane accused him of failing to disclose additional income initially, providing a supplementary affidavit.
The prosecution’s position is that the seriousness of the allegations and potential risks surrounding the investigation should be considered when deciding whether the couple should be released.
Judgment expected at midday
The Polokwane Magistrate’s Court is expected to deliver its decision at 12:00 on Friday, 4 September 2026.
If bail is granted, the magistrate will determine the conditions the couple must follow while the criminal case continues. If bail is refused, they will remain in custody pending further proceedings.
For now, the allegations against Gagash and Charlotte remain just that — allegations, with their guilt or innocence yet to be determined by a trial.
