Gagash and wife Charlotte Tibana denied bail in R6m estate fraud case

Tshwane Metro Police Department (TMPD) officer Peter ‘Gagash’ Nonyane and his wife, attorney Charlotte Tibana, have been denied bail by the Polokwane Magistrate’s Court.

SABC News reported that Magistrate Godfrey Netshiozwi ruled on Friday, 4 September 2026, that releasing the couple would create a risk of them interfering with witnesses and the ongoing investigation. The court also heard that there had already been alleged attempts to communicate with State witnesses while the pair were in custody.

Gagash and wife to remain behind bars

Gagash and Charlotte have been in custody since their respective arrests in August. They face 43 charges, including fraud, money laundering and theft, in connection with allegations involving deceased estate accounts.

The State alleges that around R6 million was allegedly defrauded from the estate accounts of six families. Other reports have put the amount at more than R4 million, reflecting different figures presented during the proceedings.

The allegations relate to estate funds that were under Charlotte’s administration as an attorney. The State has alleged that the money was used for personal benefit, including the purchase of luxury vehicles.

Court raises concerns over witnesses

A major issue during the bail application was the potential for the accused to interfere with witnesses.

The magistrate said evidence presented by the State indicated that both accused had already attempted to communicate with State witnesses while in custody. He said this was particularly concerning because some of the witnesses are beneficiaries of the estates allegedly affected by the offences, reported Daily Sun.

The State had previously argued that the couple knew the witnesses and could interfere with the investigation if released.

The defence, meanwhile, had proposed strict bail conditions. These included daily reporting to a police station, sharing their live locations with the investigating officer and, in Gagash’s case, wearing an electronic monitoring device. The defence also argued that both accused had fixed addresses and were not flight risks.

Financial questions raised in court

The court also considered questions surrounding Gagash’s finances.

During the bail proceedings, the State questioned his failure to initially disclose all his sources of income. Gagash later stated that he earned additional money through event work and as a partner in a Pretoria nightclub, according to SABC News.

The court also considered the couple’s alleged financial circumstances and the seriousness of the charges they face.

Matter postponed

Following the bail ruling, Gagash and Charlotte will remain in custody.

The matter has been postponed to 6 November 2026 as investigations continue.

The allegations against the couple have not been tested at trial, and both remain presumed innocent until proven guilty in court.
